Seven members of House Judiciary Com subcom attempt in vain on Apr 17 to reach consensus on newsmen's privilege bill; session illustrates extensive disagreements that still prevail in Cong on whether cts and grand juries should be prohibited from forcing newsmen to testify about their news sources; Repr T F Railsback says that although he opposes in principle any bill that would apply to states, he would not try to defeat such a measure if he agreed with its other provisions; Sen Judiciary Com's Subcom on Const Rights, headed by Sen S J Ervin Jr, has been trying to unite proponents of legis around single approach, specifically bill sponsored by Ervin, which would give reporter right to refuse to testify about confidential sources and unpublished information except when he had witnessed crime

D Ellsberg tells jury on Apr 26 for 1st time that he had disclosed Pentagon papers to 'give Congress the confidence to act' to end the Vietnam war, in response to question asked by defense atty L B Boudin as to why he copied papers and why they were important to him; says he had learned from reading papers that French effort in Vietnam would have failed had not US provided money, materials and bombs; says Govt that US supported in Vietnam was 'narrow based, corrupt and unrepresentative and that it had no support other than the soldiers and officials on the United States payrolls'; says there could be no victory without US 'destroying every piece of that country'; Fed Dist Judge W M Byrne ruled that Ellsberg could not answer direct question of why he copied papers for 2 reasons--one, because it was not material, and two, because it would open up what he did with copies, an issue, Byrne said, that he would not allow to be contested before jury; Ellsberg is allowed to answer question indirectly; says he believed that US codes, agent's covers and nuclear weapon information had not been compromised by release of papers

D Ellsberg says on Apr 17 under cross-examination at Pentagon papers trial that he had signed pledge while he worked for Rand Corp that he would not copy top secret documents; says that no one had given him permission either to remove Pentagon papers from Rand or to copy them; says that Xeroxing of papers was done in about 8 sessions, starting on Sept 30, '69, and going into Nov; says on some of those occasions he worked alone and other times he was helped by A J Russo Jr, L Sinay and his son Robert; says when he picked up courier passes in March and Apr of '69 to transport 1st 10 volumes of papers to Rand's Santa Monica office he did so in good faith agreeing not to copy papers that he later did
